This website is operated by ClubHouse Statues. The terms “we” and “our” throughout the site refer to ClubHouse Statues. ClubHouse Statues offers this website, including all information, tools, and services available from this site to you, the user, conditioned upon your acceptance of all terms, conditions, policies, and notices stated here.
By visiting our site and/or purchasing something from us, you engage in our “Service” and agree to be bound by the following terms and conditions (“Terms of Service”, “Terms”), including those additional terms, conditions, and policies referenced herein and/or available by hyperlink. These Terms of Service apply to all users of the site, including without limitation visitors, vendors, customers, merchants, and/or contributors of content.
Please read these Terms of Service carefully before accessing or using our website. By accessing or using any part of the site, you agree to be bound by these Terms of Service. If you do not agree to all the terms and conditions of this agreement, then you may not access the website or use any services. If these Terms of Service are considered an offer, acceptance is expressly limited to these Terms.
Any new features or tools that are added to the current store shall also be subject to the Terms of Service. You can review the most current version of the Terms of Service at any time on this page. We reserve the right to update, change or replace any part of these Terms of Service by posting updates and/or changes to our website. It is your responsibility to check this page periodically for changes. Your continued use of or access to the website following the posting of any changes constitutes acceptance of those changes.
Our store is hosted on Shopify Inc. They provide us with the online e-commerce platform that allows us to sell our products and services to you.

SECTION 1 - ONLINE STORE TERMS
By accepting these Terms of Service, you confirm that you are at least the age of majority in your state or province of residence, or that you are the age of majority in your state or province of residence and have given us your consent to allow any minors under your responsibility to use this site.
You may not transmit any worms, viruses, or any code of a destructive nature.
A breach or violation of any of the Terms will result in an immediate termination of your right to use the Services.

SECTION 2 - GENERAL CONDITIONS
All trademarks on this website belong to their respective owners; third-party trademarks, logos, product names, trade names, company names mentioned are the property of their respective holders or registered trademarks of other companies.
We reserve the right to refuse Service to anyone for any reason at any time.
You also understand that your content (except payment card data) may be transferred unencrypted and may involve (a) transmissions over various networks; and (b) changes to conform and adapt to the technical requirements of connecting networks or devices. Payment card data is always encrypted during transfer over networks.
You agree not to reproduce, duplicate, copy, sell, resell, or exploit any portion of the Service, use of the Service, access to the Service, or any contact on the website through which the Service is provided, without express written permission by us.
The headings used in this agreement are included for convenience only and will not limit or otherwise affect these Terms.

SECTION 3 - DEFINITIONS
- Deposit: amounts paid by the customer at the time of purchase for a product by order or pre-order prior to delivery. The deposit constitutes 20% of the displayed product price and remains retained in the event of cancellation of the order or pre-order by the customer.
- Product Description: all data defining a product, including but not limited to dimensions, weights, materials, and other features.
- Order: purchase made directly by the customer for a product available in stock.
- Pre-order: purchase made directly by the customer for one or more products to be manufactured or in production phase and not yet available in stock. The production time for a pre-order is stated as an indication and compliance with this timing does not bind the responsibility of any manufacturer.
- Price: the fixed price for products that must be paid by the customer for the purchase and subsequent shipment, with shipping costs included for destinations in the European Union, United States of America (excluding Alaska, Hawaii, and Puerto Rico), Canada, and Australia, remote locations excluded.
- Remote locations/areas/zones: considered a difficult, isolated, or hard-to-reach area. Shipping companies may apply a surcharge or fee for delivery to a remote location. For example, small remote islands, outlying areas, ski resorts, small remote villages, etc.
- Product(s): all physical goods that may be purchased or subscribed on our website.
- After-sales service: after-sales assistance in case of damages.

SECTION 4 - CONDITIONS OF SALE
By placing an order or pre-order, you declare to have read these general conditions of sale and to expressly accept the Terms without reservations or conditions. No general or specific condition set by the customer can override what is stated in the following Terms as incompatible. You acknowledge having received the advice and information necessary to ensure the offer meets your needs. You declare to be legally capable of entering into contracts under Italian law or validly representing the natural or legal person for whom you are acting.
You will automatically receive an order confirmation email after placing an order. All orders or pre-orders, once shipped, will be accompanied by a tracking code provided to the customer. By placing an order or pre-order, you knowingly accept to wait the necessary time for the release and delivery of your order. The release date for pre-order products is subject to production times and is indicative only. Under no circumstances can delays in production or delivery of a product be considered valid grounds for cancellation. All products sold are non-returnable, non-exchangeable (with other products), and non-refundable. Amounts paid are not refundable, as they are transferred to the manufacturer for production or to reserve the ordered product.
Import duties, taxes, or customs clearance are at the customer's expense unless otherwise stated.

SECTION 5 - ACCURACY, COMPLETENESS, AND TIMELINESS OF INFORMATION
We shall not be liable if information made available on this site is not accurate, complete, or current. The material on this site is provided for general information only and should not be relied upon or used as the sole basis for making decisions without consulting more accurate, complete, or timely sources of information. Any reliance on the material on this site is at your own risk.
This site may contain certain historical information. Historical information is not necessarily current and is provided for your reference only. We reserve the right to modify the contents of this site at any time, but we have no obligation to update any information on our site. You agree that it is your responsibility to monitor changes to our site.

SECTION 6 - MODIFICATIONS TO THE SERVICE
We reserve the right to modify or discontinue the Service (or any part or content thereof) at any time, without notice. We shall not be liable to you or to any third-party for any modification, price change, suspension, or discontinuance of the Service.

SECTION 7 - PRICES
The prices shown on our website are expressed in euro (EUR - €) by default, but in some cases are displayed to the customer based on their local currency.
Supplier prices are subject to change. Consequently, the prices of our products may change without notice. They may also change in case of special offers or sales. The applicable price is the one shown on the website on the date the customer places the order or pre-order. Shipping costs apply except for customers residing in the European Union, United States of America, Canada, and Australia, remote areas excluded (such as Alaska, Hawaii, and Puerto Rico for the United States of America). Shipping costs are expressed in euro (EUR - €) and vary depending on the delivery country chosen by the customer. For pre-orders, an estimate of shipping costs may be provided upon request from the customer. Customers located in a remote area are aware of it and will therefore be subject to additional charges, but if they are not aware, they may contact us in advance for clarification. Such costs may vary between the time of the pre-order and the actual billing, which will take place in the month prior to delivery. Any variation in delivery costs for pre-orders will be made depending in particular on the delivery country and any changes in prices charged by the transport company in charge of delivery. For customers not residing in the European Union, United States of America, Canada, and Australia (remote locations included), any customs duties or other taxes are the responsibility of the customer. For all other taxes, please check your country’s legislation.

SECTION 8 - PRODUCT OR SERVICE INFORMATION
Some products or services may be available exclusively online through the website. These products or services may be available in limited quantities. For each product offered on the site, we will indicate the essential characteristics and the price. Digital images shown may differ from the finished product. We have made every effort to display colors and images as accurately as possible of the products in the store. However, we cannot guarantee that the colors displayed on your computer monitor are accurate. Although the products on this website are presented as accurately as technically possible, representation on this website by any means (including, as applicable, graphics, images, colors, sounds) is for reference only and does not imply any guarantee as to the features of the purchased product. Descriptions, information, and photographs are the most accurate reproduction possible, but are always provided for illustrative purposes and have no contractual value, as they cannot guarantee a perfect resemblance to the manufactured products. The customer is also informed that the choice of a pre-order is based on photos of the 3D render/prototype not yet manufactured or in the manufacturing phase and that the finished product may therefore differ slightly from the photographed prototype due to handmade production or lower quality of some factories. In order to constantly improve product quality, manufacturers may have to modify product characteristics. In particular, the product may undergo changes depending on the production stages. Therefore, for quality reasons and in case of changes, scheduled release dates may be postponed. Each statue is unique and handmade.
Statues may be available in different sizes and versions:
- Regular / Standard / Normal and similar: indicates the basic version of the product.
- Deluxe / Exclusive / Ex / Premium and similar: indicates the most complete version of the product.
Packaging is not a collectible item, but is present only to protect the parcel and is numbered to ensure logistical tracking. Boxes are manufactured in limited quantities and not reproduced.
We reserve the right (though not obligated) to limit the sales of our products or Services to any person, geographic region, or jurisdiction. We may exercise this right on a case-by-case basis. We reserve the right to limit the quantities of any products or services that we offer. Descriptions and prices of products are subject to change at any time without notice, at our sole discretion. We reserve the right to discontinue any product at any time.
We do not guarantee that the quality of any products, services, information, or other material purchased or obtained by you will meet your expectations, or that any errors in the Service will be corrected.

SECTION 9 - PRE-ORDER
The customer wishing to purchase a product places his order or pre-order. To do this, log in to your customer account or place your order and create your account afterwards. Owning a customer account is essential to track your orders and ensure proper delivery.
The product page includes:
- Photos of the 3D render or prototype, based on which the Product is or will be manufactured.
- The technical characteristics of the product (scale, dimensions, etc.).
- Delivery times for pre-order products are stated in quarters, semesters, or years and do not constitute an essential condition of the sales contract. Products subject to pre-order are shipped via a specialized carrier to the address specified by the customer.
For all pre-order products, the customer can reserve them before their official release. By making a pre-order, the customer indicates their intention to order the product before it is available. For these products, the availability date is indicative only. The quantities available for each product may be changed at any time without notice. In case of shortage of stock or project cancellation, the customer will be informed as soon as possible; in such case, the order will be canceled and any amount paid will be fully refunded. We reserve the right to refuse or cancel any new order from a customer in case of unpaid invoice or insolvency.

SECTION 10 - ACCURACY OF BILLING AND ACCOUNT INFORMATION
We reserve the right to refuse any order you place. At our sole discretion, we may limit or cancel quantities purchased per person, per household, or per order. These restrictions may include orders placed by or under the same customer account, the same payment card, and/or orders that use the same billing and/or shipping address. If we make a change to or cancel an order, we may attempt to notify you by contacting the email and/or billing address/phone number provided at the time the order was made. We reserve the right to limit or prohibit orders that, in our judgment, appear to be placed by dealers, resellers, or distributors.
You agree to provide current, complete, and accurate purchase and account information for all purchases made at our store. You agree to promptly update your account and other information, including your email address, payment card numbers, and expiration dates, so that we can complete your transactions and contact you as needed. If your shipping address changes during the order, we cannot guarantee delivery to the updated address, but the original address provided at the time of ordering will prevail.

SECTION 11 - PAYMENT METHODS
Some payment methods may be subject to additional conditions and/or may entail extra costs.
All payments are processed by third-party services. Therefore, this website does not collect payment data (such as payment card numbers), but is notified once payment has been successful.
If your payment fails or is declined by the payment service provider, the website owner is not obligated to fulfill the order. Any costs or fees arising from failed or declined payments are borne by the user.
If the user authorizes PayPal’s future purchases function, this website will store an identifier code linked to the user's PayPal account, enabling this website to automatically process payments for future purchases or for the periodic installment payment of a previous purchase. Authorization can be withdrawn at any time by updating PayPal settings.
Until receipt of full payment of the purchase price, the user does not acquire ownership and usage rights to the ordered products.
The order is payable on the date of the order by secure payment, according to the payment methods offered on the site, paying the displayed amount. Any shipping costs are billed separately and are payable by the customer upon receipt of the invoice and/or the request for the order or pre-order balance. All credit and debit card transactions are charged at the time of purchase. Special payment conditions may occasionally be offered. As new payment methods are proposed, they will be described and the general sales conditions updated accordingly.
- Full payment: during an order or pre-order, full payment will be offered to individual customers. You can choose to pay the full amount and wait for production if it is not yet ready. Upon address verification, the customer will be notified of any shipping costs, which must be paid before product shipment.
- 20% deposit: during a pre-order, payment with a 20% deposit will be offered to individual customers. You can choose to pay 20% to reserve the item. The balance will be required at the end of production when the product is ready for shipping, including any shipping costs. If the customer does not respond or pay the balance within thirty (30) days from notice, we reserve the right to cancel the pre-order and not refund the paid deposit.
- Monthly installment payment: for an order or pre-order, payment in several installments will be offered to individual customers. If payment is declined by the card issuer, we will make a new attempt to charge. If the customer does not respond or pay within thirty (30) days from the first payment or charge attempt, we reserve the right to cancel the order or pre-order, retaining installments already paid and not refunding them.

SECTION 12 - PRODUCT AVAILABILITY
Product unavailability is generally indicated by the “sold out” or “out of stock” badge. The customer can also be notified when a product becomes available by subscribing to the waiting list. In any case, if unavailability was not indicated at the time of order, we commit to inform the customer as soon as possible if the product is no longer available. In case a product is unavailable, we may, if the parties agree, offer an alternative product. If the customer decides to cancel their order or pre-order due to a product being unavailable, they will receive a refund for all sums paid for the unavailable product no later than fourteen (14) days after cancellation confirmation.

SECTION 13 - WAITING LIST
If the customer wishes to purchase a limited edition product already sold out in pre-orders, they can subscribe to a waiting list. You can log into your customer account, enter the product page, and click "notify me when available" or "join the waiting list." The customer is notified that this registration in the waiting list does not constitute a pre-order or order according to these sales conditions. In case of product availability, we will contact the customer previously registered on the waiting list to provide the terms for validating their pre-order or order. We reserve the right to resell on our site products marked "sold out" before validating waiting lists. Waiting lists may remain active or be closed at any time, with or without notice to registrants.

SECTION 14 - DELIVERY TIMES
Delivery times differ for each product and depend on criteria, constraints, and artistic and technical complexity of production. Products subject to pre-order are shipped from the factory and directly to the customer via specialized carrier within thirty (30) days from the complete payment for the pre-order, provided the product is available. The customer is responsible for confirming their address before shipping. Since some products are subject to pre-order, the availability date is only indicative. Delivery times may change due to force majeure or to continually improve product quality, in particular because of production constraints in the factory. Manufacturers employ all available means to deliver the product within a reasonable time and commit to fully refund the customer for their pre-order in case of a delay in delivery exceeding thirty-six (36) months between purchase confirmation and the end of the estimated delivery period.

SECTION 15 - DELIVERY TERMS
- Packaging: For safety and protection, products may be packed in several parcels and delivered at different times.
- Shipping procedure: Products ordered are shipped to the customer by courier only after full payment. Products in pre-order are shipped at the end of mass production in the factory and delivered to the customer according to a delivery date specified on the website for information only, expressed in quarters, semesters, or years after pre-order opening. The customer will be informed of the actual delivery date at the end of mass production. In case of address change; delivery will be subject, if necessary, to update transport costs based on the new shipping address. Shipping costs may be added and billed or deducted and refunded to the customer. The product is shipped to the customer from one of our logistics warehouses in Europe or Asia. We entrust the product to a specialized carrier for delivery. The customer receives an email notifying the shipment, including the shipping date, courier name, and tracking number; for palletized shipments, no tracking number is provided. Given the volume of some products, we reserve the right to charge storage fees to customers failing to pay within seven (7) days of product arrival at the logistics warehouse.
- Delivery: Delivery terms are stated in each pre-order product description. Any discounts granted will apply to the price invoiced excluding shipping costs. Except in force majeure cases (natural disasters, health crises, social crises, wars, etc.), the previously stated elements are not exhaustive.
- Address change or customer’s absence on delivery day: In case of address change, move, or customer absence on delivery terms, contact our customer service to avoid extra charges for returns or prolonged storage. We disclaim all responsibility after product shipment if the recipient and shipping address provided by the customer are those of third parties. If a product is returned due to customer absence during delivery attempts, all return and shipping costs are charged to the customer. If the customer fully pays for the product(s) but does not receive them, we will attempt a new delivery if still available. The product will be reshipped (via appointed courier) only after the customer pays the invoice for these new shipping charges. If, after several attempts, the product is still not received, we reserve the right to cancel the order and refund only the order amount excluding shipping and deposit. For internal logistics and organization reasons, all products are shipped via a carrier chosen and appointed by our shipping agent. The customer cannot personally collect the package.
- Loss, theft, damage of the package by the carrier: In case of anomaly on the product’s tracking number via courier, the customer must contact our customer service to analyze and get support. Upon delivery to the customer, the materials of our resin products may vary if subject to temperature changes depending on the season. Customers are advised to wait 24 hours (at room temperature) after the product’s receipt before assembling. In case of delivery anomaly (damage, item missing, damaged package, broken products, carton deterioration, etc.), the customer may contact our customer service for after-sales assistance.
- Payment of taxes/customs duties: Orders of products delivered outside the European Union may be subject to import duties and taxes, collected when the package reaches the destination country entry point. Any additional customs clearance costs will be charged to the customer. We have no control over these fees. By purchasing on the website, the customer is considered the registered importer and must comply with all laws and regulations of the country in which they receive the products. International customers are advised that cross-border shipments may be opened and inspected by customs authorities. In case the customer refuses to pay customs/import duties at delivery, we reserve the right to consider the product as abandoned by the customer. No refund for the product or transport costs may be requested by the customer and we will regain ownership.

SECTION 16 - AFTER-SALES SERVICE
Resin items are naturally fragile and even if packed, packaged, and shipped as best as possible, may occasionally show damaged parts or imperfections. We offer after-sales support to our customers: The AFTER-SALES SERVICE is available five (5) days a week, Monday to Friday. Any complaint or information request must be made electronically, contacting our customer service by email at info@clubhousestatues.com. The request must be completed with clear, precise explanations and may include product photos relevant to the claim. Customers are invited to notify us within 10 (ten) days from the product’s receipt if defects, breakages, missing parts, or deterioration are found. Any requests made after this 10 (ten) day period from receipt are not covered by the offered warranty; any after-sales service costs will be charged. Each request will be processed individually. Each statue is unique with its particular marks and imperfections, being handmade and limited edition. It is common to find variations (finish, color, paint, etc.) among copies of the same product. In some cases, after-sales service may not be available.
- Damage to the shipping box (brown outer): intended to protect contents during transport.
- Damage to the colored box (art box): beyond its aesthetic appeal, it doubles as protection during transport.
- Minor damage: such as scratches, product imperfections, or factory pre-glued parts that may simply need to be re-glued to restore their original condition.
- Damage to dated products: manufacturers cannot guarantee replacement for dated items, especially if stored for a long time.
These points are not eligible for after-sales service following product receipt by the customer. Some components are factory pre-glued and may come loose due to thermal changes during long transport; customers are invited to re-glue them. If the product is damaged, we may request a replacement of the damaged part, within available replacement stock limits. Manufacturers have a spare parts warehouse with limited quantities; some parts may be reproduced upon request, unless the project is archived in the factory. For heavily damaged products, please report the issue within 24 hours of receipt.
To certify transport damages and get assistance from manufacturers, customers must record a complete unboxing video from opening the outer package to removal of each internal component, without interruption. This material is essential for correct support assessment. Without the unboxing video, manufacturers may refuse replacement or sending spare parts.
If buyers demand perfection and no issues, please do not order. We have no control over these occurrences.
We disclaim all responsibility for any product spontaneously returned by the customer without prior agreement for service. No support / restoration / replacement will be provided and the customer will need to arrange removal at their own expense. Storage fees may be billed to the customer beyond 7 (seven) days after product delivery at our warehouses.

SECTION 17 - CANCELLATION
The order or pre-order may be cancelled by the customer until the product is shipped. However, if the customer wishes to cancel their fully paid order or pre-order, they must contact us and will be refunded the order price minus 20% on the same payment method used. Customers who have only paid the 20% deposit will not be refunded and the order will be canceled. If the customer's credit card has expired, the refund may be made by wire transfer or PayPal. Any financial costs incurred by the refund shall be borne by the customer.

SECTION 18 - RETENTION OF TITLE CLAUSE
Products remain the property of the manufacturers until shipment after full payment. This retention of title clause does not prevent the transfer to the customer, upon product receipt or receipt by a third party designated other than the carrier, of the risks of loss or damage for products subject to retention, nor the risks of damage they may cause.

SECTION 19 - OPTIONAL TOOLS
We may provide you access to third-party tools, which we neither monitor nor have any control or input.
You acknowledge and agree that we provide access to such tools “as is” and “as available” without warranties, representations, or conditions of any kind and without endorsement. We shall have no liability whatsoever arising from or relating to your use of optional third-party tools.
Any use by you of optional tools offered through the site is entirely at your own risk and discretion; it is your responsibility to ensure that you are familiar with and approve the terms on which tools are provided by relevant third-party providers.
We may also, in the future, offer new services and/or features through the website (including the launch of new tools and resources). Such new features and/or services shall also be subject to these Terms of Service.

Certain content, products, and services available via our Service may include third-party materials.
Third-party links on this site may direct you to third-party websites that are not affiliated with us. We are not responsible for examining or evaluating the content or accuracy and we do not warrant and will not have any liability or responsibility for any third-party materials or websites, or for any other materials, products, or services of third parties.
We will not be liable for any harm or damages related to the purchase or use of goods, services, resources, content, or any other transactions made in connection with any third-party websites. Please review carefully the third party’s policies and practices and ensure you understand them before you engage in any transaction. Complaints, claims, concerns, or questions regarding third-party products should be directed to the third party.

SECTION 21 - COMMENTS, FEEDBACK AND OTHER SUBMISSIONS
If, at our request, you send certain specific submissions (for example contest entries) or without a request from us you send creative ideas, suggestions, proposals, plans, or other materials, whether online, by email, or otherwise (collectively, “comments”), you agree that we may, at any time, without restriction, edit, copy, publish, distribute, translate, and otherwise use in any medium any comments that you forward to us. We are and shall be under no obligation (1) to maintain any comments in confidence; (2) to pay compensation for any comments; or (3) to respond to any comments.
We may, but have no obligation to, monitor, edit or remove content that we determine, in our sole discretion, are unlawful, offensive, threatening, defamatory, pornographic, obscene or otherwise objectionable or violates any party’s intellectual property or these Terms of Service.
You agree that your comments will not violate any right of any third party, including copyright, trademark, privacy, personality or other personal or proprietary right. You further agree that your comments will not contain libelous or otherwise unlawful, abusive or obscene material, or contain any computer virus or other malware that could in any way affect the operation of the Service or any related website. You may not use a false e-mail address, pretend to be someone other than yourself, or otherwise mislead us or third parties as to the origin of any comments. You are solely responsible for any comments you make and their accuracy. We take no responsibility and assume no liability for any comments posted by you or any third party.

SECTION 22 - PERSONAL DATA PROTECTION
The customer agrees that ClubHouse Statues processes, collects, and uses their personal information, excluding financial information. ClubHouse Statues is the data controller and will process such data in accordance with applicable laws and regulations. The collection of this information is necessary for processing orders, payments, and ensuring the proper conduct of business relationships between ClubHouse Statues and the customer. This data is not disclosed to third parties. The collected data is used exclusively for the purpose of processing orders placed and to be placed by the customer. Customer data is confidential and processed exclusively by ClubHouse Statues and its service providers involved in the order and pre-order process for the purpose of the contract, its execution, and legal compliance. The customer may at any time have the right to access, modify, rectify, delete, and restrict data concerning them. To exercise these rights or to request that personal data no longer be collected, processed, or used for the purposes listed above, or to request data correction, the customer must contact our customer service.
The submission of personal information through the store is governed by our Privacy Policy.

SECTION 23 - ERRORS, INACCURACIES AND OMISSIONS
Occasionally, there may be information on our website or in the Service that contains typographical errors, inaccuracies, or omissions that may relate to product descriptions, prices, promotions, offers, shipping charges, delivery times, or product availability. We reserve the right to correct any errors, inaccuracies, or omissions by changing or updating information or canceling orders if any information in the Service or on any related website is inaccurate, at any time (including after an order has been submitted) and without prior notice.
We have no obligation to update, amend, or clarify information in the Service or on any related website, including without limitation, pricing information. No specified update or refresh date in the Service or on any related website should be taken to indicate that all information in the Service or on any related website has been modified or updated.

SECTION 24 - PROHIBITED USES
This website and the Service may only be used for the purposes for which they are offered, according to these Terms and under applicable law. The owner reserves the right to take all appropriate measures to protect its legitimate interests, including denying users access to the website or Service, terminating contracts, or reporting any objectionable activity to the competent authorities.

The Service and all products and services delivered to you through the Service (except as expressly stated by us) are provided 'as is' and 'as available' for your use, without any representation, warranties, or conditions of any kind, either express or implied, including implied warranties or conditions of merchantability, merchantable quality, fitness for a particular purpose, durability, title, and non-infringement.
In no case shall ClubHouse Statues, its directors, officers, employees, affiliates, agents, contractors, interns, suppliers, service providers, or licensors be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, special, or consequential damages of any kind — including, without limitation, lost profits, lost revenue, lost savings, loss of data, replacement costs, or any similar damages, whether based in contract, tort (including negligence), strict liability, or otherwise — arising from your use of any of the Service or any products procured using the Service, or for any other claim related in any way to your use of the Service or any product, including any errors or omissions in any content, or any loss or damage arising from the use of the Service or any content (or product) posted, transmitted, or otherwise made available through the Service, even if advised of their possibility.
Because some states or jurisdictions do not allow the exclusion or limitation of liability for consequential or incidental damages, in such states or jurisdictions our liability shall be limited to the maximum extent permitted by law.

SECTION 26 - LIABILITY
Our liability can never be engaged in the case of failure or improper performance of contractual obligations attributable to the customer, especially when placing their order or pre-order. We shall not be liable in the event of delivery anomalies (damages, missing products, damaged packages, broken products, deterioration of colored boxes or cardboard packaging during transport, etc.). We shall not be liable if the item delivered does not comply with the regulations of the country of delivery. The liability of both parties cannot be questioned if the non-performance or delay results from a force majeure event. These include, without limitation: modification requests, production delays, carrier delays, hacker attacks, unavailability of materials or components, communication network failures, and similar circumstances.

SECTION 27 - RIGHT OF WITHDRAWAL
In accordance with legal requirements, the consumer has a fourteen (14) calendar day withdrawal period. The withdrawal period expires 14 (fourteen) days after receipt of the goods or 10 (ten) days after acceptance of the offer for after-sales services. The customer acknowledges that the products are handmade with unique numbering and/or certification, are fragile, sealed, and may deteriorate following handling. However, we undertake to communicate with dissatisfied customers and find a solution, provided that the customer agrees to pay the following fees:
- Management fees;
- A 30% restocking fee;
- Costs related to repackaging and product inspection;
- Shipping costs.
In the case of multiple products ordered by the customer in a single order and delivered separately, the withdrawal period starts from the day the customer or a third party designated by the customer acquires physical possession of each item. In the case of a product composed of multiple parts, the period begins when the last piece is delivered. Customers wishing to exercise this right must contact our customer service before the end of the withdrawal period. The product must be returned within five (5) days of notifying the withdrawal decision, in its original and complete condition (original packaging, accessories, certificates, etc.) so it can be resold as new. Incomplete or improperly repackaged products may delay or result in rejection of returns and refunds. Customers are responsible for any handling exceeding what is necessary. Improper repackaging (incorrect foam fit, poor cushioning, or improper placement) may result in additional fees or rejection of the return. We assume no responsibility for loss, theft, or damage during transit. In the event of withdrawal, we will refund the product price minus the aforementioned costs. Return, shipping, and customs fees remain at the customer's expense. Refunds will be issued using the same payment method used for the original transaction. If the customer’s payment card has expired, the customer must provide new card details for the refund.

SECTION 28 - INDEMNIFICATION
You agree to indemnify, defend, and hold harmless ClubHouse Statues, its parent, subsidiaries, affiliates, partners, officers, directors, agents, contractors, licensors, service providers, subcontractors, suppliers, interns, and employees from any claim or demand, including reasonable legal fees, made by any third party due to or arising out of your breach of these Terms of Service or the documents they incorporate by reference.

SECTION 29 - SEVERABILITY
In the event that any provision of these Terms of Service is determined to be unlawful, void, or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed severed from these Terms of Service, such determination shall not affect the validity and enforceability of any other remaining provisions.

SECTION 30 - TERMINATION
The obligations and liabilities of the parties incurred prior to the termination date shall survive the termination of this agreement for all purposes.
These Terms of Service are effective unless and until terminated by either you or us. You may terminate these Terms of Service at any time by ceasing to use our site.
If in our sole judgment you fail, or we suspect that you have failed, to comply with any term or provision of these Terms of Service, we may terminate this agreement at any time without notice and you will remain liable for all amounts due up to and including the date of termination, and/or accordingly may deny you access to our Services (or any part thereof).

SECTION 31 - ENTIRE AGREEMENT
Failure by us to exercise or enforce any right or provision of these Terms of Service shall not constitute a waiver of such right or provision.
These Terms of Service and any policies or operating rules posted by us on this site or in respect to the Service constitute the entire agreement and understanding between you and us and govern your use of the Service, superseding any prior or contemporaneous agreements, communications, and proposals, whether oral or written, between you and us (including, without limitation, any prior versions of the Terms of Service).
Any ambiguities in the interpretation of these Terms of Service shall not be construed against the drafting party.

SECTION 32 - NULLITY
In the event that any clause of these general conditions of sale is declared null, such nullity shall not automatically invalidate all the provisions herein, which shall continue to have full effect.
